Family Law: Stalking and Restraining Orders

If you have been a victim of physical abuse or threatened abuse as defined in the statute from a member of your household or family, you may be able to get a restraining order under the Oregon "family abuse prevention act." The abuse usually must have occurred within the preceding six months, and you must be in imminent danger of further abuse. As part of a FAPA order, the court can decide who will live in the family home and who will have custody of the children. It is very important to have strong legal representation in a restraining or stalking order proceeding due to the long lasting effect that the result of such a hearing can have.
