In Oregon all family law cases are decided solely by a judge. Sometimes judges make mistakes. Sometimes the judge rules in your favor and the other party is upset with the ruling. There are very important and non-modifiable filing requirements for an appeal. This includes timely serving and filing the "Notice of Appeal." If these steps are not taken properly then an appeal will be dismissed. It is important when considering an appeal or responding to an appeal to have proper legal counsel.

In family law cases, the Court of Appeals reviews the judge's ruling de novo. This means that the court takes an entirely new look at the case. The court must rely on the trial judge's analysis of witness credibility and cannot look at any evidence that was not presented to the trial judge.

Mr. Margolin worked at the Oregon Court of Appeals after law school assisting the judge's in their case review and opinion drafting.
