Family Law: Child and Spousal Support

The legislature provides that parents need to financially support their children. In some circumstances, parents must support college age adults under 21 if they meet certain requirements. Child support issues can come up in divorce cases, custody cases, paternity cases, and modifications of preexisting support orders. The Division of Child Support put together a calculator for child support which can be viewed here: http://dcs.state.or.us/calculator/default.htm. The number produced by the formula is presumed to be correct, there are many "rebuttal" factors that may affect the final support amount.

In many divorce cases, the court requires one spouse to pay the other spousal support (formerly known as alimony). The court can order three types of support, transitional, compensatory, and maintenance support. Unlike child support, there is no calculator. Instead, there court of appeals cases and a series of statutory factors the court considers when setting support.
